# Terms of Service
Refresh Games

These Terms of Service ("Terms") govern your access to and use of any game, software, or service operated by Refresh Games ("we," "us," or "our"), including but not limited to BREACH and VECTOR (each a "Game," collectively the "Games"). By downloading, accessing, or playing any of our Games, you agree to these Terms.
If you do not agree, do not use our Games.

## 1. Eligibility
You must be at least 13 years old to use our Games. If you are under the age of majority where you live, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Some Games or platforms may have higher age requirements based on content rating or platform policy. You are responsible for complying with the age requirements of the platform you are playing on.
## 2. License to Use the Games
We grant you a limited, non-exclusive, non-transferable, revocable license to download and play our Games for personal, non-commercial use, as long as you comply with these Terms and applicable laws.
This license applies to each Game individually and may be revoked for any Game if you violate these Terms.
## 3. Accounts and Online Services
Our Games may use third-party services for multiplayer, backend, and online features, including but not limited to Photon, PlayFab, and the relevant platform services (such as Meta, Steam, or others).
Use of online features may require a stable internet connection and may be subject to service interruptions, maintenance, or updates. You are responsible for maintaining the security of your platform account and for all activity that occurs through it.
## 4. Player Conduct
You agree not to:
- Harass, threaten, abuse, or harm other players
- Use hate speech or discriminatory content
- Cheat, exploit bugs, or use unauthorized mods or third-party software
- Attempt to disrupt servers or networking systems
- Reverse engineer, decompile, or attempt to extract source code not permitted by law
- Use our Games for commercial purposes without our permission
- Impersonate Refresh Games staff or other players
We may suspend or restrict your access to any or all of our Games if you violate these rules. Violations in one Game may result in action across other Refresh Games titles.
## 5. User Content
If a Game allows you to upload, share, or transmit content (such as names, text, voice, or other player-facing content), you:
- Retain ownership of your content
- Grant us a worldwide, non-exclusive, royalty-free license to use, host, reproduce, and display it solely for operating, improving, and promoting our Games
- Represent that you have the right to share that content
We may remove content that violates these Terms or applicable policies.
## 6. Purchases and Virtual Items
Our Games may offer virtual items, cosmetics, or currency. All purchases are handled through the relevant platform store (Meta, Steam, etc.) and are subject to that platform's payment terms and refund policies.
Unless required by law, virtual items:
- Have no real-world value
- Are not redeemable for cash
- Are not transferable outside the Game in which they were purchased
- Are not transferable between Refresh Games titles unless explicitly stated
We may modify, rebalance, or remove virtual items or progression systems to maintain gameplay integrity.
## 7. Game-Specific Terms
In addition to these general Terms, each Game may have additional terms based on its platform and features:
BREACH is available on Meta Quest and Steam. Use of BREACH is also subject to the terms of the platform you play on, including Meta's Terms of Service and Steam's Subscriber Agreement. BREACH includes voice chat and multiplayer features.
VECTOR is subject to the terms of the platform it is distributed on. Multiplayer features, virtual items, and online services in VECTOR are governed by the same general rules in these Terms.
If any platform's terms conflict with these Terms, the platform's terms will control for matters related to that platform's services (such as payment processing and account management).
## 8. Updates and Changes to the Games
We may update, patch, or change any of our Games at any time. This can include adjusting gameplay, features, items, or online requirements. We do not guarantee that any specific feature, item, or game mode will remain available indefinitely.
We may also discontinue a Game entirely. If we do, we will provide reasonable notice where possible.
## 9. Service Availability
We strive to keep our Games available, but we do not guarantee uninterrupted access. Online features may be impacted by:
- Maintenance
- Bugs or technical issues
- Third-party service outages (including Photon, PlayFab, or platform services)
- Discontinuation of online services for older titles
## 10. Termination
You may stop using our Games anytime.
We may suspend or terminate your access to one or more of our Games if:
- You violate these Terms
- We believe your use risks harm to other players, our Games, or our services
- Required by law or platform policy
Sections that should reasonably survive termination will remain in effect.
## 11. Intellectual Property
All rights, title, and interest in our Games, including artwork, code, characters, names, logos, audio, and other content, are owned by Refresh Games or our licensors. Nothing in these Terms grants you ownership of any part of our Games.
You may not copy, distribute, sell, or create derivative works of our Games or assets without our written permission. We actively enforce our IP rights, including on platform stores.
## 12. Disclaimer of Warranties
Our Games are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
## 13. Limitation of Liability
To the fullest extent permitted by law, Refresh Games will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of our Games.
Our total liability for any claim related to a Game will not exceed the amount you paid (if any) to access that Game in the 12 months prior to the event giving rise to the claim.
(Some jurisdictions do not allow certain limitations, so these may not apply to you.)
## 14. Privacy
Your use of our Games is also governed by our Privacy Policy. Please review it to understand how we collect and use information.
## 15. Governing Law
These Terms are governed by the laws of the United States and the state where Refresh Games is based, without regard to conflict of law principles, unless your local consumer protection laws require otherwise.
## 16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and may provide additional notice where appropriate. Continued use of any of our Games after changes means you accept the updated Terms.
